  1. Introduction

These Terms and Conditions (“Terms”) govern the use of this webshop, fibertone-guitars.com operated by Fibertone Guitars, Rok Drobun s.p, registration number: 8855005000, and the purchase of goods offered herein. By purchasing any product from this webshop, you (the “Buyer”) agree to these Terms. The Seller reserves the right to amend these Terms without prior notice.

  1. Ownership

2.1. This website is the property of Fibertone Guitars, Rok Drobun s.p. All material on this website is copyright to Fibertone Guitars, Rok Drobun s.p, and is provided solely for your personal, non-commercial use. You may not use this website for any commercial purpose without express written permission.

  1. Product Description and Pricing

3.1. The guitars sold on this webshop are handmade from high-quality carbon fiber materials. Due to the artisanal nature of the products, minor variations in finish and appearance may occur and do not constitute a defect.

3.2. We take every care to ensure that product descriptions are accurate at the time of uploading. The Seller reserves the right to withdraw any product from the website without prior notification and to amend prices without prior notification.

3.3. All prices are displayed in EUR and may include applicable taxes where noted. Any additional duties, taxes, or import fees for international orders are the responsibility of the Buyer.

  1. Ordering Goods

4.1. When an order is placed on our website, you will receive a confirmation email confirming we have received your order and it is being processed. A second email will be sent when the order has been dispatched, including tracking information where applicable.

4.2. All products are subject to availability. Display of products on our website is an invitation and not an offer to sell. An offer is made when the Buyer places an order.

4.3. If products are out of stock, subject to delay, or priced incorrectly, we will contact you at the email address provided. If no response is received, we may cancel the order or process the remaining items. Replacement products will not be supplied without authorization from the Buyer.

  1. Shipping and Delivery

5.1. The Buyer is responsible for providing accurate shipping information. The Seller is not liable for delays or issues caused by incorrect or incomplete shipping details provided by the Buyer.

5.2. Risk of loss passes to the Buyer upon delivery of the product to the shipping carrier.

  1. Returns Policy

6.1. Stock Guitars:

Stock guitars can be returned within 10 days of delivery for a full refund. The product must be returned in its original packaging, in excellent condition. The Buyer is responsible for return shipping costs.

6.2. Custom Guitars:

Custom-made guitars are not returnable under any circumstances. Custom orders include guitars built to the Buyer’s specifications or modified using the Seller’s customization options.

6.3. Return Process:

To initiate a return, contact us to receive a return authorization and instructions. 

6.4. Refund Process:

Following an inspection of the returned product, refunds will be processed to the original payment method within 7-10 business days. The Seller is not responsible for import duties or taxes incurred prior to delivery.

  1. Payment Methods and Time of Purchase

7.1. The time of purchase is defined as follows:

For payments via credit card or PayPal, the purchase is considered complete when the payment is processed successfully.

For bank transfers, the purchase is considered complete when the Seller receives the payment in their bank account. The Buyer acknowledges that delays in bank processing or international banking systems may affect this timing.

For Bitcoin payments, the purchase is considered complete when the transaction is confirmed in the Bitcoin network.

7.2. Refunds for Bitcoin payments will be issued in the USD value equivalent to the Bitcoin amount at the time of payment or refund, as calculated based on the prevailing exchange rate.

  1. Product Durability

8.1. The guitars are made of carbon fiber, a highly durable material that is resistant to most forms of wear and damage under normal use. However, misuse, abuse, or extreme conditions can lead to damage for which the Seller is not responsible.

  1. Limitation of Liability

9.1. The Seller’s liability is limited to the purchase price of the product. The Seller is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the product.

  1. Governing Law and Dispute Resolution

10.1. These Terms shall be governed by the laws of the Republic of Slovenia.

10.2. Any disputes arising from the purchase of products shall first be attempted to be resolved amicably between the Buyer and Seller. If no resolution can be reached, the dispute will be subject to the exclusive jurisdiction of the courts in Ljubljana, Slovenia.

  1. Force Majeure

11.1. The Seller shall not be held liable for delays or failures to fulfill obligations due to events beyond their reasonable control, including but not limited to acts of God, pandemics, supplier delays, or governmental restrictions.

  1. Intellectual Property

12.1. All content, images, and product designs on this webshop are the intellectual property of the Seller and may not be reproduced, distributed, or used without explicit written permission.

  1. Privacy

13.1. The Seller values the Buyer’s privacy and will handle all personal data in compliance with applicable data protection laws. Personal information will only be used for the purposes of order fulfillment and communication.

  1. Final Provisions

14.1. By purchasing from this webshop, the Buyer acknowledges that they have read, understood, and agreed to these Terms.

14.2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
